Are you looking for a compassionate and aggressive divorce attorney to support you in this emotionally draining and challenging situation? You will need solid legal advice if your spouse served you with divorce papers or if you are moving forward with a separation. Nielsen Law has experienced family law attorneys who are aware of the lasting consequences of a divorce to those involved and are willing to help. The attorneys will give you legal representation from the first consultation to the final verdict.

Divorce options.

How you proceed with the divorce process significantly impacts you and your family. The various divorce options will provide a positive resolution to your divorce case. You do not have to go to the courtroom to get a divorce and solve all the legal issues associated with it. The spouses can work together and decide the best approach to resolve issues such as spousal support, child custody, child support, and asset and debt distribution. According to your family and individual needs, choose a divorce option that is best for you. The divorce options include:

1. Mediation.

The couple sits together in a room with a trained third-party neutral mediator, who makes difficult conversations happen. The mediator guides the spouses in resolving legal issues associated with divorce. After the discussions and a resolution has been reached, the attorney drafts a separation agreement.

2. Separation agreement.

It is a contract between spouses that shows how both parties plan to handle their affairs during the separation period. The spouse can use mediation, negotiation, or collaborative divorce, to create the separation agreement terms.

3. Collaborative divorce.

With the help of a trained collaborative attorney, both parties work through their legal issues outside court through respectful discussions. If needed, a mental health professional and a financial planner is brought into the discussions. Collaborative divorce differs from mediation in that the spouses are represented by a collaborative attorney.  The collaborative divorce attorney drafts the resulting resolution in a separation agreement.

4. Negotiation.

The spouses agree on how to transition from one family unit to a two-family unit. The spouses can talk it out or send drafts back and forth with the help of an attorney. The attorney drafts the separation agreement from resolutions made during the negotiation.

5. Court.

Both parties go to court and tell their story to the judge. The judge will issue an order to resolve all the issues.

What should you consider when selecting a divorce attorney?

  1. They should communicate clearly to represent you in the court proceedings. The attorney should update you on the latest developments of your case and help you make informed decisions.
  2. The best attorney is experienced, competent, and skilled. Find a family or divorce attorney who has tackled a case that is similar to yours.
  3. The attorney should be available to respond to your questions at crucial times in your case.

Conclusion.

The decision you make about how to proceed with the divorce affects you as an individual and your family significantly. Hiring a divorce attorney makes the divorce process fast and cheaper. It is possible to solve divorce outside the courtroom in some states. The divorce options include negotiation, separation agreement, mediation, collaborative divorce, or court. When looking for an attorney, do proper research and look out for certain qualities.
